These Terms and Conditions (“Terms”) govern your use of the services provided by Procon 24/7 (“we,” “us,” “our,” or “the Company”), a company registered in England and Wales, and your use of our website www.proconcrete247.co.uk.

By placing an order, using our services, or accessing our website, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use our services.

2. Services Provided

We provide ready-mixed concrete and screed delivery services throughout Yorkshire and the North West of England, operating 24 hours a day, 7 days a week from our operating depots:

  • Yorkshire Operating Depot: 13 Carlisle Road, Leeds LS10 1LB
  • North West Operating Depot: Parkside Road, Warrington WA3 1PG
  • Yorkshire Head Office: Unit 1 Colonels Trading Estate, Colonels Walk, Pontefract WF8 4GX

3. Ordering and Quotations

3.1 Order Placement

All quotations are valid for 30 days from the date issued unless otherwise specified. Quotations are not binding until we confirm acceptance of your order in writing.

3.3 Order Confirmation

We will provide written confirmation of your order including:

  • Delivery date and time
  • Concrete/screed specification
  • Quantity ordered
  • Total price including delivery charges
  • Any special requirements or conditions

3.4 Minimum Orders

All deliveries are subject to a minimum charge of 2m³ plus delivery charges at the current rates set out in our official price list.

4. Payment Terms

4.1 Payment Requirement

No concrete will be poured unless payment has been made, except for approved account customers with established 30-day trade accounts.

4.2 Payment Methods

We accept payment by:

  • Credit/debit card
  • Bank transfer
  • Cash (subject to prior arrangement)
  • 30-day trade account (subject to credit approval)

4.3 Payment Processing

  • Payment will not be taken until agreed amounts are signed on the delivery ticket by both parties
  • A pre-authorization for your delivery will be taken when the order is placed
  • For 30-day trade account holders, orders will be added to your account balance

4.4 Payment Security and Retention

We reserve the right to securely retain card details within our payment system in compliance with GDPR and PCI DSS standards. We may take payment at our discretion for:

  • Cancellation charges in accordance with our cancellation policy
  • Additional waiting time charges
  • Charges for damage to our vehicles or property while under your instruction
  • Any unpaid invoices or outstanding balances

4.5 Late Payment

For trade account customers:

  • Payment terms are 30 days from invoice date
  • Late payment interest may be charged at 8% per annum above the Bank of England base rate
  • We reserve the right to suspend services for overdue accounts

4.6 Ownership of Materials

All materials remain our property until full payment is received. Title and risk pass to the customer only upon complete payment.

5. Cancellation Policy

5.1 Cancellation Notice

Cancellations require a minimum of 24 hours’ notice before the scheduled delivery time.

5.2 Late Cancellation Charges

Failure to provide 24 hours’ notice will result in a cancellation charge of £120 per scheduled wagon.

5.3 Weather-Related Cancellations

We reserve the right to cancel or postpone deliveries due to adverse weather conditions that may compromise safety or product quality. No cancellation charges apply for weather-related cancellations initiated by us.

6. Delivery Terms

6.1 Delivery Scheduling

  • Delivery times are estimates and may vary due to traffic, weather, or operational requirements
  • We will provide updates if significant delays are anticipated
  • Customers must ensure site access is available at the scheduled time

6.2 Site Access and Requirements

  • Customers must ensure adequate access for our delivery vehicles
  • Hard standing areas must be provided for vehicle positioning
  • Any special access requirements must be communicated at the time of ordering

6.3 Unloading Time Allowance

  • Standard allowance is 10 minutes per m³ ordered
  • Unloading time arrangements must be confirmed prior to delivery
  • Customer must provide adequate labor and equipment for unloading

6.4 Waiting Time Charges

Waiting time exceeding the standard allowance is charged at £3 per minute.

7. Health and Safety

7.1 Chemical Hazard Warning

WARNING: Concrete and screed can cause alkali burns. Non-porous protective clothing should be worn at all times when handling our products.

7.2 Temperature Advisory

When air temperature is below 5°C or above 30°C, fresh concrete may not comply with BS EN 206/BS 8500 standards. Acceptance of delivery during these conditions is at the customer’s risk.

7.3 Site Safety

  • Customers are responsible for ensuring their site is safe for our personnel and vehicles
  • All relevant health and safety regulations must be observed
  • Customers must provide appropriate PPE requirements and safety briefings if required

8. Liability and Insurance

8.1 Vehicle and Property Damage

Customers are liable for any damage to our vehicles and/or property while the vehicle is under your instruction, including both private and public property damage.

8.2 Off-Highway Liability

Customers accept full liability for vehicle recovery costs and any damage incurred if our vehicles are asked to leave public highways.

8.3 Product Liability and BSI Compliance

  • We warrant that our products will conform to agreed BSI specifications at the time of delivery
  • Any modifications to our products (including adding water or other substances) immediately voids all warranties and transfers full liability to the customer
  • Our liability is limited to replacement of genuinely defective products or refund of charges paid for unmodified products only
  • We are not liable for consequential or indirect losses, particularly where products have been modified post-delivery

8.4 Limitation of Liability

Our total liability for any claim shall not exceed the value of the specific order in question

8.5 Insurance Requirements

Customers must maintain adequate public liability insurance (minimum £2 million) when requesting delivery to private premises.

9. Product Specifications and Quality

9.1 BSI Standards and Specifications

All concrete and screed supplied is designed and manufactured to comply with BSI (British Standards Institution) specifications, including BS EN 206 and BS 8500 standards, at the point of delivery.

9.2 Product Modifications and Customer Liability

IMPORTANT: Any modifications made to our products after delivery, including but not limited to:

  • Adding water to the mix
  • Adding any additives or admixtures
  • Altering the concrete or screed composition in any way
  • Modifying the specified mix design

Will immediately void all warranties and make the customer fully liable for any product failure, performance issues, or non-compliance with BSI standards.

Our products are precisely engineered to meet specific performance criteria and BSI specifications. Any alteration to the mix design compromises the integrity and performance of the concrete or screed and transfers complete liability for failure to the customer.

9.3 Testing and Certification

  • Test certificates are available upon request
  • Additional testing requirements must be specified at the time of ordering
  • Costs for additional testing will be charged separately

9.4 Product Acceptance

Products are deemed accepted upon discharge from our vehicles unless defects are immediately reported. Once accepted, any subsequent modifications to the product are entirely at the customer’s risk and liability.

10. Force Majeure

We shall not be liable for any failure to perform our obligations due to circumstances beyond our reasonable control, including but not limited to:

  • Acts of God, natural disasters, extreme weather
  • Government regulations or restrictions
  • Labor disputes, strikes, or industrial action
  • Equipment failure or supply chain disruptions
  • Pandemic-related restrictions or closures

Trade account applications are subject to credit checks and approval. Terms and credit limits will be confirmed in writing.

For business customers, title in goods remains with us until payment is received in full.
